Johansen, Baber. A response to Ann Elizabeth Mayer's review of 'The Islamic Law on Land Tax and Rent: The Peasants' Loss of Property Rights as Interpreted in the Hanafite Legal Literature of the Mamluk and Ottoman Periods.'... International Journal of Middle East Studies v24, n3 (August, 1992):553 (3 pages). Abstract: Ann Elizabeth Mayer neglects the argument and mangles the quotations from Baber Johansen's book 'The Islamic Law on Land Tax and Rent' in her review of it. The term 'mal' is exchange value and 'taqawwum' is not a value established by bargaining, as Mayer wrongly asserts. She also wrongly believes that 'ghasb' only applies to coercive appropriation, whereas it can apply to any non-contractual use. She neglects to mention in her review that Johansen's use of the term 'corpus iuris' is derived from Chehata's usage.
